These Rental Terms constitute the agreement between DUSA Rent a Car ("Lessor") and the person renting the vehicle ("Renter") and are governed by the Turkish Code of Obligations No. 6098, Highway Traffic Law No. 2918, Consumer Protection Law No. 6502, Personal Data Protection Law No. 6698 and related legislation. By creating a reservation, the Renter is deemed to have accepted these terms.
1. Parties and Definitions
- Lessor: Dusa Rent a Car, Gevher Nesibe Mah. Kocasinan Bulvarı Yazırdağ Apt. No:188/2 Kocasinan, Kayseri.
- Renter: The natural or legal person who rents the vehicle on their own behalf or on behalf of another.
- Vehicle: The motor vehicle selected during reservation or assigned as an equivalent class.
- Rental Period: The time between pick-up and drop-off, calculated in full 24-hour increments.
2. Rental Requirements
- The Renter and any additional driver must be at least 18 years old. Certain premium (SUV, prestige) classes may require a minimum age of 25.
- A valid driving licence must be presented. The licence must have been issued at least 1 year prior to the rental date. Non-Turkish licences require a valid translation or an International Driving Permit.
- Turkish citizens must present their 11-digit T.R. identity number; foreign nationals must present a valid passport number.
- The original of the ID and driving licence must be presented at pick-up; copies or digital images are not accepted.
- The Renter confirms having read and accepted the KVKK (GDPR-equivalent) disclosure regarding personal data processing.
3. Reservation and Payment
- A reservation is valid only once confirmed in writing (e-mail/SMS) by the Lessor.
- Payment may be made by credit card, bank transfer or cash at pick-up. For foreign nationals, only an internationally valid credit card is accepted.
- At pick-up, a pre-authorisation hold (amount varies by vehicle class) is placed on the Renter's credit card. The hold is released upon a clean return; release may take 1–30 business days depending on the issuing bank.
- Prices include VAT unless stated otherwise. Traffic fines, HGS/OGS toll passes, parking, fuel and optional add-ons are not included.
4. Pick-up and Return
- The vehicle is delivered at the location and time stated in the reservation. For one-way rentals (different return location), the drop-off surcharge set for that location applies.
- A 59-minute grace period is granted at return. Any delay beyond this grace period is charged as a new full day.
- Vehicle condition, mileage, fuel level and existing damage are recorded on a joint inspection form at both pick-up and return.
- Out-of-hours returns are permitted only with prior written approval; in such cases the vehicle remains under the Renter's responsibility and is inspected on the next business day.
5. Additional Driver
Only the Renter named in the contract and any approved additional driver may operate the vehicle. Age and licence requirements apply equally to the additional driver. Use by any third party not named in the contract voids all insurance coverage and the Renter is solely liable for any resulting damage.
6. Fuel Policy
The vehicle must be returned with the same fuel level recorded at pick-up (full-to-full basis). Missing fuel is charged at the current pump price together with the location's refuelling service fee.
7. Mileage and Use Restrictions
- Mileage allowance: 300 km/day, 1,500 km/week, 3,500 km/month. Excess mileage is charged per kilometre.
- The vehicle may not be used for racing, speed tests, driving instruction, towing, off-road driving, commercial freight, paid passenger transport, or sub-renting.
- Smoking or carrying unrestrained pets inside the vehicle is prohibited; a cleaning fee applies in case of violation.
- The vehicle may not be taken outside Turkey without the Lessor's prior written consent.
8. Insurance and Liability
- All vehicles are covered by compulsory third-party liability insurance and comprehensive (CDW) insurance.
- Coverage does not extend to: use under the influence of alcohol/drugs, use by an unlicensed or non-contractual driver, tyre/wheel/glass/headlight damage (unless mini-damage package purchased), interior damage and key loss.
- The Renter is liable up to the insurance deductible in any at-fault event. The optional Super CDW package eliminates the deductible.
- Claims without a police report, alcohol test and scene photographs void the insurance; in such cases the full damage is charged to the Renter.
9. Traffic Fines, Tolls and Parking
All traffic fines, HGS/OGS toll charges, parking fines and related administrative penalties incurred during the rental period are the Renter's responsibility. Such amounts are charged to the Renter once officially notified to us, together with a processing fee.
10. Breakdown and Accident Procedure
- In the event of any breakdown, accident or damage, the Renter must immediately notify the Lessor at 0542 119 38 38.
- In case of an accident, the Police (155) or Gendarmerie (156) must be called to issue an official accident report. Emergency Medical (112) must be called for any injury.
- The vehicle may not be taken to any third-party service or tow operator without the Lessor's written approval.
11. Late and Early Return
- Delays exceeding 59 minutes are charged a full additional day. For unreported delays over 24 hours, the Lessor reserves the right to unilaterally terminate the agreement and pursue all available legal remedies.
- Early returns are generally non-refundable for unused days; special terms apply only to promotional bookings as published.
12. Cancellation, Changes and Right of Withdrawal
- Cancellations and changes made at least 48 hours before pick-up are free of charge. Cancellations made under 48 hours incur a penalty equal to the first day's rental fee.
- Under Consumer Protection Law No. 6502 and Article 15/1-g of the Distance Contracts Regulation, vehicle rental performed on a specific date is exempt from the right of withdrawal; the standard 14-day withdrawal right does not apply.
- In force majeure cases (natural disaster, official mobilisation, sudden medical condition, etc.), documented cancellations are processed free of charge.
13. Protection of Personal Data
The Renter's personal data is processed under Law No. 6698 (KVKK) solely for the purpose of delivering the rental service, fulfilling legal obligations and managing customer relations. For details, please review our KVKK Disclosure and Privacy Policy.
14. Dispute Resolution
Any dispute arising from this contract shall first be addressed through amicable resolution. Where no settlement is reached, consumer arbitration committees have jurisdiction within the monetary thresholds of Law No. 6502; for amounts above these thresholds, the Courts and Enforcement Offices of Kayseri shall have exclusive jurisdiction. The contract is governed by the laws of the Republic of Türkiye.
15. Entry into Force
These Rental Terms enter into force upon reservation and remain in effect until the vehicle is returned and all accounts are settled. The Lessor reserves the right to update these terms in accordance with legal obligations or service changes. The current version is always published on this page and becomes effective from the date of publication.
